الملخص

يتناول هذا البحث دراسة الأحكام الشرعية الحاكمة لإدارة الأوقاف الإسلامية عبر العقود الذكية وتقنيات الذكاء الاصطناعي، مع بيان كيفية توظيف التكنولوجيا الحديثة وعلى رأسها تقنية البلوك تشين (Blockchain) لتوثيق المعاملات الوقفية وتنفيذها آليًا في ضوء مقاصد الشريعة الإسلامية وضوابطها الأخلاقية، مع إبراز التجربة السعودية ضمن رؤية 2030 .

abstract

This research explores the Shariah rulings governing the management of Islamic endowments (awqaf) through smart contracts and artificial intelligence (AI) technologies. It clarifies how emerging digital tools—particularly Blockchain technology—can be used to automate, record, and secure waqf transactions in accordance with Islamic legal principles. The study highlights the compatibility of smart contracts with the pillars of Islamic contracts (consent, intention, and lawful subject) while addressing challenges such as programming errors and digital documentation of intent. It also examines the role of AI in enhancing transparency, accountability, and efficiency in waqf administration, alongside the pioneering Saudi experience in digital transformation under Vision 2030.
