دور منظمة العمل الدولية في حماية حقوق العمال

الملخص

تناولت هذه الدراسة الدور الجوهري الذي تضطلع به منظمة العمل الدولية (ILO) بوصفها منظمة متخصصة تهدف إلى إرساء السلام العالمي عبر العدالة الاجتماعية. استعرضت الدراسة الظروف التاريخية لنشأة المنظمة عقب الحرب العالمية الأولى وتطور دستورها وصولاً إلى إعلان فيلادلفيا 1944. تكمن مشكلة الدراسة في رصد مدى كفاية الآليات الدولية لحماية العمال في ظل التحولات الاقتصادية الراهنة. اعتمدت الدراسة على المنهج الوصفي التحليلي لتشريح الهيكل التنظيمي الفريد للمنظمة القائم على “التمثيل الثلاثي” (حكومات، أصحاب عمل، عمال). وتوصلت الدراسة إلى نتائج أبرزها: نجاح المنظمة في صياغة ترسانة قانونية تتجاوز 180 اتفاقية وتوصية شملت حقوقاً جوهرية مثل تحديد ساعات العمل، وحظر العمل القسري، وحقوق العمال المهاجرين. واختتمت الدراسة بتوصيات تؤكد ضرورة تعزيز الآليات الردعية الدولية لضمان التزام الدول بالمعايير العمالية، وربط حقوق العمال بمنظومة حقوق الإنسان الشاملة.

abstract

This study examines the pivotal role of the International Labour Organization (ILO) as a specialized agency dedicated to establishing global peace through social justice. The research explores the historical context of the ILO’s establishment following World War I and the evolution of its constitution up to the 1944 Declaration of Philadelphia. The problem of the study lies in assessing the adequacy of international mechanisms for protecting workers amidst current economic transformations. Utilizing a descriptive-analytical approach, the study deconstructs the ILO’s unique “Tripartite Structure” (governments, employers, and workers). Key findings indicate that the organization has successfully developed a legal framework of over 180 conventions and recommendations covering fundamental rights, such as working hours regulation, the prohibition of forced labor, and the rights of migrant workers. The study concludes with recommendations emphasizing the need to strengthen international deterrent mechanisms to ensure state compliance with labor standards and to integrate labor rights within the comprehensive human rights framework.
